Online Retail Terms and Conditions of Sale (Terms of Sale)
Bunnings Pacific is pleased to offer you the opportunity to buy and receive Products from Bunnings Pacific through the Website on the basis of the following terms:

Orders
a. For each Product listed in your Checkout Summary, your order is an offer from you to Bunnings Pacific to buy that Product from us. A contract for the supply of the Product from us to you will be formed under these Terms of Sale when your payment has been accepted by us in Australia and we have sent you an email order confirmation.
b. We are responsible for dispatching the Products to you under these Terms of Sale. Products will be dispatched to you from Australia.
c. All accepted orders of Products supersede all previous quotes/estimates that may have been provided to you.
d. We reserve the right to limit the quantity of Products purchased by you.

Information about Products
Due to photographic and screen limitations associated with the representation of Products, some actual Products may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Website.

Pricing and payment
a. You must pay for all online purchases at the time of online checkout prior to order confirmation in accordance with one of the payment methods offered on the Website. Where we cannot fulfil an order, a refund will be provided under clause 8.
b. The prices of Products, and any delivery or other charges shown are in Fiji dollars.

Delivery
a. Delivery options are listed on our Website. The delivery option selected by you and the applicable estimated delivery times will be shown in your Checkout Summary. We will use reasonable endeavours to deliver Products within the time frame shown.
d. You will be notified via email once your Products have been dispatched.
e. We are unable to accept liability for delay in delivering Products which are beyond our reasonable control.
f. You must ensure there is clear and safe access for delivery. You must ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, we will endeavour to deliver the Product if safe and appropriate to do so.
g. Some Products may require extra delivery personnel which will incur an additional charge as advised to you before you submit your order.

Title and risk
By placing an order for Products, you acknowledge that you are the official importer of record for the ordered Products. Title and risk of loss or damage to Products purchased by you shall pass to you upon delivery of the Product to the third party carrier.

Warranties and liability
a. All Products come with consumer guarantees. You are entitled to a replacement or a refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
b. Products may contain warranty documents on or inside the packaging provided by the manufacturer or distributor of the Product. Unless clearly expressed otherwise, any such warranty is not given by Bunnings Pacific.
c. All other warranties are excluded, except those which are non-excludable in law, including the Australian Consumer Law and the Fijian Competition and Consumer Commission Act. Subject to applicable laws, where Products supplied are not of a kind ordinarily acquired for personal, domestic and household use, Bunnings Pacific’s liability to you is limited to refunding the price or replacing the relevant Products (at Bunnings Pacific’s option).
d. To assist Bunnings Pacific in resolving any problems you may experience, please inspect the Product upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar problem to us as soon as you become aware of it.

Order Cancellation
a. Bunnings Pacific may cancel any order (in full or part) where:
i. we reasonably suspect that you are purchasing the Product/s for the purposes of resale or resupply (other than where you are a builder or tradesperson and you are resupplying the goods to your customers in the course of that trade);
ii. we become aware after order confirmation that the Product/s is out of stock;
iii. there has been a genuine pricing or Product description error; or
iv. where the transaction is suspected of being the subject of credit card or payment-related fraud, or any other criminal activity.
b. We will refund any amount already paid in respect of any cancelled order. In the case of part cancellation of an order, a refund will be provided on the amount paid that relates to the cancelled portion of the order.

Privacy
a. Bunnings Pacific collects your personal information to allow us to supply you with Products and services. By providing us with your personal information you agree to this policy.
10. Dispute resolution and governing law
These Terms of Sale are governed by Australian law. If you have a complaint, dispute or any other feedback relating to a Product purchased from Bunnings Pacific, you may submit your complaint to Contact Us and we will investigate and respond to your complaint.
11. Third Party Services
Where you arrange and book for any third party services through the Website, you contract separately with that third party. Bunnings Pacific will not be liable for any services provided by a third party.
12. Inconsistency
These Terms of Sale, together with, Bunnings Pacific policies available on the Website, apply to the exclusion of all other terms and conditions. In the event of any inconsistency between those documents, these Terms of Sale will take precedence to the extent necessary to resolve that inconsistency.
13. Definitions
a. Bunnings Pacific, we, us or our means Bunnings Group Limited;
b. Checkout Summary means the summary of your purchase of Product/s presented to you prior to confirmation of your purchase on the Website;
c. Product means any goods and services available for purchase from Bunnings Pacific on the Website;
d. Website means the Bunnings Pacific website available at https://bunningspacific.com
